Zipmi is a product of ZipVisa, Inc., a Delaware corporation ("ZipVisa," "we," "us," or "our"). This Terms of Service Agreement ("Agreement") governs your use of Zipmi's DS-160 preparation and submission tool (the "Platform").
By creating an account, accessing the Platform, or clicking "I Agree" or a similar acknowledgment, you confirm that you have read and understood this Agreement and agree to be legally bound by it. This click-through acceptance constitutes a valid, binding electronic signature under applicable law. If you do not agree, you may not use the Platform.
1. Scope of Services
Zipmi and ZipVisa, Inc. are not affiliated with, endorsed by, or acting on behalf of the U.S. Department of State, the U.S. government, or any other government agency. The official DS-160 form is available free of charge directly from the U.S. Department of State at ceac.state.gov. Zipmi is an independent tool that helps you prepare and organize your own information before you submit it yourself.
Using the Platform does not increase, decrease, or otherwise affect your chances of visa approval. All decisions on your application are made solely by the U.S. Department of State.
Zipmi is a self-service technology platform that helps you:
- Create a profile and enter your own information for a DS-160 nonimmigrant visa application.
- Review and edit that information before submission.
- Electronically sign and submit the completed DS-160 directly to the U.S. Department of State, at your direction.
- Store your information for your own reference and for use on future applications, if you choose.
ZipVisa does not review, verify, correct, or supplement the information you enter. The Platform takes the data you provide and formats it into a DS-160 application; ZipVisa does not independently check that data for accuracy, consistency, or eligibility. You are solely responsible for reviewing every field before you submit.
ZipVisa is not a law firm, government agency, or visa sponsor. We do not offer legal advice, and your use of the Platform does not create an attorney-client relationship.
2. Eligibility and User Accounts
To use the Platform on your own behalf, you must be at least 18 years old and legally able to enter into contracts.
If you are a parent or legal guardian entering information and completing a DS-160 on behalf of a minor child, or on behalf of another person for whom you hold legal authority to act, you must yourself be at least 18 years old, and you represent that you have the legal authority to act on that person's behalf. Minors may not independently create or operate a Zipmi account.
By registering, you confirm that:
- You will provide complete and accurate information, to the best of your knowledge.
- You will not share your account credentials.
- You will immediately report any unauthorized access to or use of your account.
3. Access and Use Rights
Subject to compliance with this Agreement, ZipVisa grants you a limited, non-exclusive, non-transferable, and revocable license to use the Platform for your own personal DS-160 preparation (or, where applicable, on behalf of a minor or person under your legal authority). You may not:
- Reverse-engineer, decompile, or modify the Platform.
- Sell, lease, sublicense, or share your access to the Services with anyone else, including offering to complete DS-160 applications for others as a paid or unpaid service through your account.
- Use automated scripts, bots, or other tools to scrape, mine, or extract data from the Platform without ZipVisa's express written consent.
- Interfere with the operation or integrity of the Services.
All rights not expressly granted here are reserved by ZipVisa.
3.1 Acceptable Use
You agree to use the Platform only for lawful purposes. The following conduct is strictly prohibited:
- Submitting fraudulent, falsified, or fabricated information in your DS-160 application or any related document.
- Uploading forged, altered, or counterfeit documents, including passports, prior visas, or other government-issued identification.
- Misrepresenting your identity, your relationship to the person you are applying for, or your authority to act on their behalf.
- Accessing or attempting to access another user's account or data without authorization.
- Uploading or transmitting malicious code, viruses, or content that could harm the Platform or its users.
ZipVisa reserves the right to investigate suspected violations and to suspend or terminate any account found to be in breach, and may report unlawful conduct to appropriate authorities.
4. Your Responsibilities
By using the Platform, you:
- Are solely responsible for the truthfulness, accuracy, and completeness of every answer you enter, understanding that the DS-160 is a legal document submitted under penalty of perjury.
- Acknowledge that ZipVisa does not check, correct, validate, or supplement your answers in any way — what you enter is what will appear on your application.
- Are solely responsible for carefully reviewing every field of your DS-160 before you click to sign and submit, including on the confirmation screen presented immediately before submission.
- Understand and agree that clicking "Sign and Submit Application" (or similar language) is your own act of electronically signing and submitting your DS-160 to the U.S. Department of State. ZipVisa's role is limited to formatting and transmitting the data you provided, at your direction; ZipVisa does not submit applications as an independent decision-maker and does not review them for you.
- Understand that once submitted, a DS-160 generally cannot be edited or withdrawn through the Platform or otherwise, and that responsibility for any errors, omissions, or misstatements rests with you.
- Acknowledge that job placement, visa issuance, and all immigration outcomes are determined solely by the U.S. government and are not guaranteed by ZipVisa in any way.
- If acting as an Authorized Representative for a minor or another person, confirm that you have the legal authority to complete and submit the application on their behalf, and accept the same responsibility for the accuracy of that application as you would for your own.
5. Privacy and Data Use
Use of the Platform is also governed by our Privacy Policy.
- We use encrypted storage and vetted third-party processors to handle your data.
- We may anonymize and aggregate data to improve our services; aggregated data will not identify any individual.
- We retain personal information only as long as necessary to provide the Services or as required by law, and will delete or de-identify it upon account deletion, subject to legal retention obligations.
You grant ZipVisa a license to store and process your data solely for the purpose of providing the Services described in this Agreement.
6. Availability and Updates
ZipVisa uses reasonable efforts to maintain high platform availability. We may perform scheduled maintenance, roll out security patches, and update the Platform from time to time; some updates may be required to continue using the Platform. The Platform may be offered in a beta or early-access phase during which features may be incomplete or subject to change; ZipVisa makes no warranty of uninterrupted availability during this period.
7. Modifications to Terms
We may revise these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms. We will notify you of material changes via email or the Platform.
8. Intellectual Property
All content and software on the Platform is the property of ZipVisa or its licensors. You may not copy, modify, or distribute our content or brand elements without written permission. Feedback or suggestions you voluntarily submit about the Platform may be used by ZipVisa without restriction or compensation; you grant ZipVisa a perpetual, royalty-free license to use such input.
9. No Legal Advice
ZipVisa is not a law firm and does not provide legal representation or advice. Any general information provided through the Platform is for informational purposes only and does not constitute legal advice. If you have questions about your visa eligibility or immigration strategy, you should consult a qualified immigration attorney.
10. Disclaimer of Warranties, Limitation of Liability & Exclusion of Damages
10.1 Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:
- Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement;
- Any warranty that the Platform will be uninterrupted, error-free, or secure;
- Any warranty regarding the accuracy, reliability, or completeness of information you enter, since ZipVisa does not review or verify that information;
- Any warranty that a DS-160 submitted through the Platform will be accepted, or that any visa or other immigration outcome will result from use of the Platform.
10.2 DS-160-Specific Disclaimer
ZipVisa expressly disclaims liability related to DS-160 applications prepared or submitted through the Platform. Specifically:
- ZipVisa is not responsible for visa denials, delays, revocations, or any adverse immigration outcome, regardless of whether the DS-160 was prepared using the Platform.
- Every DS-160 application is generated solely from the information you enter and is reviewed and submitted by you. ZipVisa does not independently prepare, verify, or submit DS-160 applications on your behalf.
- Any errors, omissions, or inaccuracies in a submitted DS-160 — however they arose — are your sole responsibility, since you reviewed and personally triggered the submission.
- ZipVisa makes no representation that a DS-160 prepared through the Platform will be accepted, approved, or deemed complete by the U.S. Department of State or any other government authority.
10.3 Exclusion of Consequential and Other Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZIPVISA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; LOSS OF DATA, VISA OPPORTUNITY, OR ANTICIPATED IMMIGRATION OUTCOME; OR DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PLATFORM — REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ZIPVISA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.4 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZIPVISA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL FEES YOU PAID TO ZIPVISA IN THE THREE (3) MONTHS PRECEDING THE CLAIM. DURING ANY FREE ACCESS OR BETA PERIOD, THIS AMOUNT SHALL BE ZERO.
11. Termination
We may suspend or terminate your account for violation of these Terms. You may stop using the Platform at any time. Upon termination, your data will be handled as described in our Privacy Policy.
12. Indemnification
You agree to indemnify, defend, and hold harmless ZipVisa and its officers, directors, employees, and affiliates from third-party claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, the information you submitted, your violation of applicable law, or any breach of this Agreement.
13. Force Majeure
ZipVisa is not liable for delays or failure to perform resulting from causes beyond its reasonable control, including acts of God, internet outages, pandemics, or government restrictions or shutdowns affecting DS-160 processing.
14. Export Compliance
You agree not to use the Platform in violation of U.S. export control laws, including restrictions on use in embargoed countries or by persons on the U.S. Treasury's Specially Designated Nationals list.
15. Confidentiality
Any non-public technical or business information ZipVisa discloses to you in connection with the Platform will be treated as confidential, except where disclosure is required by law. This does not apply to your own personal information, which is governed by our Privacy Policy.
16. Governing Law & Language
This Agreement is governed by the laws of the State of Delaware. Any dispute shall be resolved through binding arbitration in Wilmington, Delaware, except where applicable consumer-protection law requires otherwise.
This Agreement is written in English, and the English-language version governs in all respects. Any translation is provided for convenience only, and the English version controls in the event of a conflict.
17. Assignment
You may not assign or transfer your rights or obligations under this Agreement without ZipVisa's prior written consent. ZipVisa may assign this Agreement to an affiliate, successor, or acquirer in connection with a merger, acquisition, or sale of assets, without notice to you.
